"They" claim that the statement promotes illegal behavior, but what if the bong was full of tobacco or a "bong hit" was some computer gaming thing? Did the prosecution really prove that a "bong hit" as used in that sign was an illegal activity?

But then, maybe I should look into it some more...

Well, it's ironic this time, given that, as it says in the final paragraph in the above link:
Conservative groups that often are allied with the administration are backing Frederick out of concern that a ruling for Morse would let schools clamp down on religious expression, including speech that might oppose homosexuality or abortion.
As for filibuster, remember that this was the old roll-over-and-play-dead Democrats, not the current we'll-bark-twice-if-we-don't-like-it-then-lie-down Democrats. I do wish that they'd forced the current Republican Majority to use the "nuclear option"; that would have set a fantastic precedent.

That's my only consolation amidst all the abuses of the post-9/11 government; all the shit the GOP pulled is going to come back to haunt them one day.
